1. Organizing company
Well Cares Swimming (WCS) is registered in the commercial registry of the Chamber of Commerce under number 87063778.
2. Risk and Health
All participants declare to waive any and all claims that they have or may have in the future against Well Cares Swimming from any and all liability for any loss, damage, injury, expense, or other cost that may be suffered related to their participation in the swimming sessions due to any cause whatsoever. Attendance at the swimming lesson is at your own risk. WCS needs to be in the possession of at least one emergency phone number in case of an accident or issue.
3. Safety and general rules
Swimmers are responsible for their own safety, actions, and behaviour on any part of the swimming pool property, including the changing area. Shoes must be removed before entering the poolside. Safety for all is our primary concern, and WCS reserves the right to remove anyone on, in, or around the pool who gives any cause for concern regarding safety. Swimmers must not run, act inappropriately, or behave recklessly once within the pool vicinity. WCS shall not be responsible for any damage, loss, injury, or costs caused as a result of swimmers disobeying these rules. WCS does not accept liability for sickness, personal injury, or death of any of the participants whilst attending WCS sessions.
4. Student registration
After the try-out session, each swimmer will be assigned, following consultation, to a fixed swimming location and a fixed day and time. Requests to transfer to another day, time, or pool must be made by email, and WCS will make reasonable efforts to accommodate such requests, subject to availability. Upon enrolment, participants agree to prepay for 10 sessions, valid for 3 months (13 weeks). This constitutes a multi-pass that allows for up to 3 missed sessions per 3-month period (equivalent to 12 per year) without financial consequence. Once the 10 sessions have been completed, or when the pass expires after 13 weeks (regardless of attendance), a new pass must be purchased.
Lesson cancellation by participant
If a swimmer is unable to attend a scheduled lesson, the absence must be reported via the personal portal, at least 8 hours prior to the scheduled start time. Cancellations made less than 8 hours before the lesson cannot be processed and will be fully charged and recorded as not cancelled in time.
Booking extra lessons
Extra lessons can be booked directly by each swimmer through their personal portal, at any available WCS location.
5. Lesson cancellation by management
WCS will make every effort not to cancel a lesson. However, the management reserves the right to alter the time of a lesson when necessary due to staff illness, essential pool maintenance, pool closure, or other unforeseen circumstances (“Force Majeure”). In such cases, no refund will be issued. WCS will provide as much notice as possible of any such cancellation and shall not be liable for any losses incurred as a result.
6. Privacy
All personal information of our students will be treated with full respect for privacy and handled in accordance with the WCS Privacy Policy. Personal data will not be shared with third parties unless WCS is legally required to do so. WCS adheres to a Code of Conduct for privacy and swimmer protection, ensuring a respectful and safe learning environment. At times, instructors may take photographs and/or videos at WCS venues for marketing, promotional, or educational purposes, which will only be used in compliance with this policy.
7. Code of conduct at the swimming facility
WCS and its students are guests at each hired facility. All swimmers and accompanying persons must act in accordance with the rules of the swimming location and follow any instructions given by facility staff. All other guests and staff on-site must be treated with respect and not disturbed in any way, before, during, or after lessons. WCS maintains a Code of Conduct that applies to all swimmers, parents, and staff, ensuring mutual respect, privacy, and a safe and positive learning environment. In the event that a swimmer, parent, sibling, or other associate refuses to follow instructions, behaves in an unruly manner, or causes damage to the premises or equipment, WCS reserves the right to terminate the contract immediately without refund or credit. The swimmer may also be excluded from future WCS courses.
8. Valuables and jewelry
WCS will not accept liability for the loss of or damage to any personal effects brought to any session and you are therefore requested to ensure that no valuable items are brought to the swimming lessons. All property left at any WCS venue whether it is in a changing room, on poolside, left in entrance halls or outside, is done so at your own risk. WCS cannot accept any responsibility for the loss or damage of any personal belongings.
9. Cancellation of your enrolment
Participants may cancel their enrolment at any time. However, once a participant has attended the first swimming session following the try-out, they are obliged to pay the full fee for the 10-session cycle, regardless of whether they continue with the lessons or not. Missed sessions are non-refundable. This provision also applies if the cancellation is not communicated in due time. In accordance with the cancellation procedure, a new 10-session card must then be purchased and paid for.
10. Complaints
WCS is fully committed to delivering the highest standards of teaching & coaching. If you are not entirely satisfied with the service that WCS provides, we would like to hear about it. If we become aware of any problem while you are still attending a course or activity, we will aim to resolve this at an early stage. You can be assured that any complaint will be taken very seriously and treated with the utmost professionalism.
11. Governing Law
Dutch Law shall govern these terms and conditions and you agree that any disputes shall be resolved exclusively by the Dutch Courts.
